Comprehensive Privacy Notice

1. Identity and address of the data controller

AgroWatts S.A. de C.V. (“AgroWatts”) is the data controller for the personal data collected through this website.

This notice is issued under Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), published in the Official Gazette (DOF) on 20 March 2025 (last amended DOF 14-11-2025), in particular articles 14 to 16.

2. Personal data we process

Where Data How it is processed today
Contact form Name, email, company (optional) and message. When you submit it, the data is stored in Netlify Forms (our hosting provider’s form service) and we are notified at [PENDIENTE: notification email]. We also record the language, the page it came from and any campaign (UTM) parameters in the link.
Downloadable guide (lead magnet) Name, email and profile. Same as the contact form (Netlify Forms).
Equipment quote (catalog) Item, category and quantity; name, email, phone (optional), company (optional) and message. Same as the contact form (Netlify Forms).
Solar farm land lease (guidance) Name, email, phone (optional), state, municipality, hectares, tenure type, current use, offer stage and, if you wish, the company, rent and term offered and your message. Same as the contact form (Netlify Forms). Use it only for your own land or with the other right holders’ permission.
Solar farm services Name, email, company, role, phone (optional), service, project size and state, and message. Same as the contact form (Netlify Forms).
Notify me / waitlist (shop) Product or variant of interest and email. Same as the contact form (Netlify Forms). We only use it to tell you about that product.
Quote tool / pre-sizing Project data: region, area, plot polygon (KML/GeoJSON), tariff, electricity-bill consumption and amount, pumps and loads, rainfall and irrigation water. Contact data: name, email, WhatsApp (phone) and company or farm. Calculations and reading the polygon file happen in your browser. Only if you submit the request do we store your contact details, the project data and the estimated result, including the polygon, in Netlify Forms. The electricity-bill amount and the estimated savings are asset (financial) data: they are only sent if you tick the express-consent box; if you do not, the rest of the request is sent without them.
Free 15-minute call (Google Calendar appointment page, link or embedded view) What the booking page asks for: name, email, phone number, chosen date and time and any notes. Google processes the booking on its platform and records it in our calendar.
Browsing the site Technical data: IP address, browser and device type, pages requested, date and time. Netlify, our hosting provider, processes them in logs to run and secure the site.

We do not collect sensitive personal data. Please do not include them in your messages. The site is not aimed at minors.

3. Purposes of processing

Primary purposes (needed):

  1. Reply to your messages and requests for information.
  2. Prepare and send the pre-sizing or quote you request, and follow up technically and commercially on that request.
  3. Schedule, confirm and hold the 15-minute call.
  4. Send you the guide or materials you ask for.
  5. Run the site and keep it secure.

Secondary purposes (not needed; you may refuse):

  1. Send you AgroWatts newsletters, news, promotions and content you did not request.
  2. Invite you to events, webinars and surveys.

To refuse secondary purposes, email the address in section 1 with the subject “No to secondary purposes”. Refusing does not affect how we handle your requests.

4. Transfers and processors

  • AgroWatts does not sell or rent your personal data and makes no transfers that require your consent. We could only share them without consent in the cases of article 36 LFPDPPP, for example at the request of a competent authority.
  • If we ever need to transfer your data (for example, to a partner integrator or installer to carry out your project), we will update this notice and ask for your consent where the law requires it.
  • Providers (processors). Some operate outside Mexico, so processing may take place abroad:
    • Netlify (hosting and form handling via Netlify Forms);
    • Google (appointment page and calendar).
    When you use Google Calendar, Google also processes your data under its own terms.
  • External links. The site links to the global agrivoltaics community on Discord, to our AgriVolt Bot assistant on Telegram (t.me/AgriVoltBot), to X (@Agro_Watts), LinkedIn and secondlifeofsolar.org. If you visit them, their own privacy notices apply.

5. ARCO rights: how to exercise them

You have the right to Access, Rectify or Cancel your data, or to Object to its processing (arts. 21–26 LFPDPPP). Send your request to the email in section 1 with the subject “ARCO rights”, including (art. 28):

  1. Your name and a way to receive the reply.
  2. A document proving your identity or your legal representative’s.
  3. A clear description of the data concerned (except for access).
  4. The right you are exercising or what you request.
  5. Anything that helps locate your data. For rectification, state the correction and attach support.

We will reply within 20 business days. If the request is upheld, we will carry it out within the following 15 business days. Both periods may be extended once by an equal period (art. 31). The procedure is free, except reproduction or shipping costs (art. 34). If you get no reply or disagree, you may go to the Secretaría Anticorrupción y Buen Gobierno within the following 15 days (art. 40).

6. Withdrawing consent

You may withdraw your consent at any time, without retroactive effect (art. 7), by emailing the address in section 1 with the subject “Withdrawal of consent”. The same procedure and time limits as for ARCO rights apply.

7. Options to limit the use or disclosure of your data

Write with the subject “Limit use of data” and we will add you to an internal exclusion list. Every promotional email will include a way to unsubscribe.

8. Cookies, local storage and similar technologies

  • We do not use analytics tools or advertising pixels.
  • Technical cookie NEXT_LOCALE (lasts 1 year): remembers the site language (es/en). It contains no personal data.
  • Local storage aw_discord_dismissed: remembers whether you closed the Discord community banner.
  • Fonts are served from our own hosting. They are not loaded from Google Fonts.
  • If you open the embedded booking view, Google loads that content and may use its own cookies.

You can clear cookies and local storage in your browser settings.

9. Retention and security

We keep data only as long as needed for the purposes described and then for the legal blocking period before deletion (art. 24). Specific period: [PENDIENTE]. We apply reasonable administrative, technical and physical security measures.

10. Changes to this privacy notice

We will publish any change on this same page (the “Privacy notice” link in the site footer) with the date of last update. When a change affects the purposes or requires your consent, we will also tell you through the contact details you gave us.
